0. Beta Software Notice

LuhaRide may be provided as beta or pre-release software. Features may change, be incomplete, or temporarily unavailable. You use the Service at your own risk during the beta phase. Please report bugs and issues via Help → Support in the app. Continued use of the Service means you accept this condition.

1. Acceptance of Terms

By accessing or using LuhaRide ("Service"), you agree to be bound by these Terms & Conditions. If you disagree with any part, you may not use our Service.

These terms constitute a legally binding agreement between you and TECHMCU (the operator of LuhaRide).

2. Who We Are

LuhaRide is a technology platform operated by TECHMCU that connects passengers with independent taxi drivers and taxi unions in Uttarakhand and nearby areas.

Important: We are NOT:

  • A taxi company or transport operator
  • An employer of drivers
  • The owner or operator of vehicles on the platform
  • A payment processor or financial intermediary

We provide the technology to connect riders with drivers. Drivers and unions are independent third parties who use our platform.

3. User Eligibility

  • You must be at least 18 years old to create an account
  • For driver accounts, you must hold a valid driving licence as required by Indian law
  • For union accounts, you must be an authorized representative of a registered taxi union
  • You must provide accurate and truthful information during registration
  • One person may not create multiple accounts to abuse the system

4. Platform Role and Limitations of Liability

LuhaRide acts only as a technology intermediary. Drivers, unions, and their vehicles are independent third parties.

Drivers and unions are solely responsible for:

  • Valid driving licences, vehicle registration, insurance, and permits required by law
  • Vehicle safety, maintenance, and roadworthiness
  • Compliance with Motor Vehicles Act and traffic regulations
  • Safe driving and passenger safety during trips
  • Not exceeding legal seating capacity
  • Providing accurate vehicle and route information
Limitation of Liability: To the fullest extent permitted by law, TECHMCU, LuhaRide, and their representatives are NOT LIABLE for accidents, injuries, death, property damage, delays, loss, theft, disputes, or any harm arising during or after trips arranged through the platform, except where liability cannot be excluded by law.

We do not guarantee driver behavior, vehicle condition, or trip outcomes. Use the Service at your own risk.

5. Passenger Responsibilities

  • Provide accurate contact information (phone, email, WhatsApp)
  • Arrive at pickup points on time
  • Respect drivers and other passengers
  • Do not misuse bookings or repeatedly no-show without valid reasons
  • Do not engage in harassment, abuse, or unlawful behavior
  • Verify driver identity and vehicle details before boarding
  • Report safety concerns immediately via the app or emergency services (dial 112)
  • Pay the agreed fare as per your arrangement with the driver

Consequences: Repeated violations may result in warnings, temporary suspension, or permanent account termination.

6. Driver and Union Responsibilities

  • Maintain valid driving licence, RC, insurance, and permits as required by Indian law
  • Ensure vehicle is safe, clean, and roadworthy
  • Do not exceed legal seating capacity shown on vehicle RC
  • Drive safely and follow all traffic rules
  • Provide accurate route, fare, departure time, and vehicle information
  • Upload genuine documents during verification (Aadhaar, DL, RC) - fake documents will result in permanent ban
  • Honor confirmed bookings; frequent cancellations may affect your account
  • Treat passengers with respect and professionalism
  • Do not engage in fraud, overcharging, harassment, or misconduct

Document Verification: Submitted documents will be reviewed by admin. Approval typically takes 24-48 hours. Providing false or fraudulent documents may result in account suspension and legal action.

7. Bookings and Cancellations

Booking Process:

  • Passengers select seats on available trips
  • Bookings require driver approval (shown as "Pending" until confirmed)
  • Once approved, passenger receives driver contact details

Cancellation Policy:

  • Passengers can cancel bookings up to 2 minutes before scheduled departure
  • Drivers can reject booking requests before approval
  • Last-minute cancellations (within 2 minutes) are not allowed to protect driver planning
  • Repeated cancellations or no-shows may result in restrictions

We may send in-app notifications where technically possible, but cannot guarantee delivery. Check the app regularly for booking updates.

8. Payments — Platform Does NOT Handle Money

CRITICAL: LuhaRide and TECHMCU DO NOT collect, hold, process, or transfer fare money between passengers and drivers.

How Payment Works:

  • LuhaRide is only a connection platform — we help users find each other
  • Fare payment is settled directly between passenger and driver
  • Payment method (cash, UPI, bank transfer, etc.) is agreed between users
  • Payment amount and timing are decided by users directly

Platform Has NO Responsibility For:

  • Non-payment or late payment by passengers
  • Overcharging or undercharging by drivers
  • Refunds, chargebacks, or payment disputes
  • Fraudulent transactions, scams, or theft involving payments
  • UPI/payment app errors or failures

Dispute Resolution: Payment disputes must be resolved between passenger and driver directly, or through appropriate legal channels. We do not mediate financial disagreements. Report fraud or safety issues via Help → Support.

9. Reviews and Ratings

  • Passengers can rate and review drivers after completed trips
  • Reviews must be honest, relevant, and respectful
  • We may remove reviews that contain abusive language, false information, or violate community guidelines
  • You cannot delete ratings given to you by others
  • Manipulating ratings (fake reviews, review bombing) is prohibited and may result in account suspension

10. Account Security and Verification

Your Responsibility:

  • Keep your password confidential
  • Use a strong, unique password
  • Do not share your account with others
  • Report unauthorized access immediately

Verification Process:

  • New accounts may be verified via OTP (One-Time Password) sent to your phone or email
  • Driver accounts require document verification (Aadhaar, DL, RC) which typically takes 24-48 hours
  • Union accounts require union registration documents and leader verification
  • We watermark all uploaded documents with "LuhaRide - Verification Copy" to prevent misuse

11. Prohibited Conduct

You may NOT:

  • Provide false, misleading, or fraudulent information
  • Upload fake or altered verification documents
  • Impersonate another person or entity
  • Use the Service for illegal activities (human trafficking, drug transport, etc.)
  • Harass, threaten, or abuse other users
  • Scrape, copy, or reverse engineer the app
  • Create multiple accounts to manipulate bookings or ratings
  • Use automated bots or scripts
  • Attempt to hack, breach security, or access unauthorized data
  • Spam users with unsolicited messages

Consequences: Violations may result in immediate account suspension, permanent ban, and potential legal action.

12. Intellectual Property

The LuhaRide platform — including source code, system architecture, business logic, data models, workflows, visual design, branding, and user experience — is proprietary to TECHMCU or its licensors.

Our Implementation: While we use industry-standard tools (Flutter, Node.js, PostgreSQL, nginx, etc.) that have their own licenses, the overall LuhaRide implementation as a product is our proprietary work. How these components are combined, configured, and operated to deliver the Service is our intellectual property.

You May NOT:

  • Copy, reproduce, or create derivative works of the app
  • Reverse engineer, decompile, or disassemble the software
  • Remove or alter copyright notices or branding
  • Use "LuhaRide" name or logo without written permission

13. Data and Privacy

We process personal data to operate the Service (name, phone, email, location, trip history, verification documents). See our Privacy Policy for details.

Key Points:

  • We do NOT sell your personal data
  • Verification documents are stored securely and deleted after account closure (subject to legal retention requirements)
  • You can delete your account anytime via Profile → Settings → Delete account
  • Account deletion requires password confirmation

14. Account Suspension and Termination

We may suspend or terminate your account if you:

  • Violate these Terms & Conditions
  • Engage in fraud, abuse, or illegal activity
  • Pose a safety risk to other users
  • Provide false verification documents
  • Receive repeated negative reports from other users

We will notify you of suspension where practical, unless immediate action is required for safety or legal reasons.

You May Delete Your Account: You can permanently delete your account anytime via Profile → Settings. This action is irreversible and deletes all your data (see Privacy Policy for details).

15. Service Availability and Changes

  • We strive for 24/7 availability but do not guarantee uninterrupted service
  • Service may be temporarily unavailable for maintenance, updates, or technical issues
  • We may add, modify, or remove features at any time
  • We may change pricing, policies, or service areas

Material changes will be communicated via in-app notifications or email when practical.

16. No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Accuracy, reliability, or availability of information
  • Error-free or uninterrupted operation
  • Driver competence, vehicle safety, or trip outcomes

17. Indemnification

You agree to indemnify and hold harmless TECHMCU, LuhaRide, and their directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Any content you submit (reviews, documents, photos)

18. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Jurisdiction: Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of courts in Dehradun, Uttarakhand, except where mandatory consumer protection laws require otherwise.

Dispute Resolution: We encourage resolving disputes amicably via our support email before taking legal action.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
